Please read these Terms carefully before using the 2Bigha platform, including all subscription-based services. By accessing our website, mobile application, or any related service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using the 2Bigha platform — whether as a guest, registered user, or paid subscriber — you agree to be bound by these Terms of Use, our Privacy Policy, and any additional guidelines or policies referenced herein. If you do not agree with any provision, you must discontinue use of the platform immediately.

These Terms apply to all users, including buyers, sellers, investors, and service partners.

1.1 Definitions

To these Terms, the following words and expressions shall have the meanings assigned to them below:

"Company / 2Bigha"
means My Two Bigha Private Limited, a company incorporated under the Companies Act, 2013, operating the platform under the brand name 2Bigha.
"Platform"
means the website, mobile application, software systems, technology tools, digital infrastructure, and related services operated by the Company under the name 2Bigha, including all features, functionalities, and subscription services.
"User"
means any individual, entity, or organisation that accesses, browses, registers on, or uses the Platform, including buyers, sellers, investors, agents, property owners, or visitors.
"Subscriber"
means a User who has purchased or activated any paid or free subscription plan offered by the Platform.
"Content"
means any data, information, text, images, graphics, photographs, videos, land records, documents, maps, listings, descriptions, trademarks, logos, software, or other material uploaded, posted, shared, transmitted, or otherwise made available on the Platform by Users or the Company.
"Listing"
means any property-related information uploaded on the Platform, including details relating to agricultural land, farmhouses, investment properties, or related assets.
"Subscription Plan"
means any pricing plan offered by the Company for enhanced access to platform features, including but not limited to Silver, Gold, and Platinum plans.
"Services"
means all services provided through the Platform, including property listing facilitation, subscription-based visibility tools, analytics features, property discovery tools, land investment support services, farm-related opportunities, and other digital utilities provided by the Company.
"Account"
means the registered profile created by a User to access and use the Platform.
"Applicable Laws"
means all laws, statutes, regulations, rules, guidelines, circulars, and governmental requirements applicable in India, including but not limited to the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023, and other relevant laws.
"Third Party Services"
means services provided by external vendors including payment gateways, KYC verification providers, legal experts, analytics tools, or technology service providers integrated with the Platform.
"Intellectual Property"
means all copyrights, trademarks, service marks, patents, trade secrets, database rights, software rights, and proprietary rights associated with the Platform.

2. Our Services

2Bigha provides a technology-driven platform offering the following services:

  • Tools for connecting buyers, sellers, and investors across India.
  • Subscription-based services offering enhanced listing visibility, analytics, and verified/pro badge features.
  • Property management and land investment support services.
  • Utility tools such as area converter for land measurement calculations.
  • Access to agricultural land opportunities including farms and investment-focused properties.

3. Subscription Plans & Billing

3.1 Available Subscription Plans

2Bigha offers tiered subscription plans based on duration and features. The current plans, pricing, and listing access are as follows (subject to change with prior notice):

Additional Benefits:

  • Gold & Platinum plans include enhanced listing visibility features.
  • Platinum plan includes premium features: Pro Agent Sticker, Featured Listing, and Social Media Promotion.
  • Diamond Pro includes Legal Document Verification and Verified Property Badge.
  • All prices are inclusive of GST.

Note: Prices are exclusive of applicable GST (18%) unless stated otherwise. 2Bigha reserves the right to revise pricing. Any such changes will be communicated via email and will apply from the next subscription billing cycle.

3.2 Billing Cycle & Auto-Renewal

  • Subscriptions are billed at the beginning of each billing cycle (1 month, 3 months, or Annual) as selected at the time of purchase.
  • Subscriptions do not auto-renew. Access will end automatically at the conclusion of the selected billing period.
  • A reminder notification will be sent at least 7 days prior to the subscription expiry date.
  • You may choose to manually renew your subscription at any time before or after it expires through your account settings under “Manage Subscription.”

3.3 Payment Methods

  • Accepted payment methods include UPI, Credit/Debit Cards (Visa, Mastercard, RuPay).
  • All payments are processed through PCI-DSS compliant third-party payment gateways. 2Bigha does not store your card details.
  • Failed payments due to insufficient funds or expired cards will result in temporary suspension of subscription benefits.

3.4 Invoicing & GST

  • A GST-compliant invoice will be sent to your registered email within 24 hours of successful payment.
  • Users must provide a valid GSTIN at the time of subscription to claim input tax credit.
  • 2Bigha's GSTIN and registered entity details will be available on the invoice and on the platform's legal page.

4. Cancellation Policy

You may cancel your subscription at any time. The following terms apply upon cancellation:

  • Cancellation takes effect at the end of the current billing cycle. You will continue to have access to subscription features until the cycle ends.
  • No pro-rata refund is provided for the unused portion of an ongoing billing cycle.
  • To cancel, navigate to Account Settings > Subscription > Cancel Subscription, or write to us at contact@2bigha.ai with your registered email and subscription ID.
  • Cancelling a subscription does not delete your account. Your listing data and account history will be retained for up to 12 months after cancellation. Any active property listings will expire with immediate effect and will only be visible in your personal dashboard.

5. KYC & Verification

2Bigha reserves the right to request identity verification (KYC) or supporting documents for any listing or account at its sole discretion.

Failure to provide requested documentation may result in suspension or removal of listings or account access.

6. Listing Removal

2Bigha reserves the right to review, reject, edit, or remove any listing or content that violates these Terms, is misleading, unlawful, or negatively impacts platform integrity, without prior notice.

7. Content & Listings Disclaimer

All property listings, descriptions, images, and related content are provided for general informational purposes only. While efforts may be made to maintain accuracy, 2Bigha does not guarantee or warrant the authenticity, legality, ownership, or completeness of any listing. Specifically, 2Bigha does not guarantee:

  • The legal ownership, clear title, or encumbrance-free status of any listed land.
  • The absence of disputes, court orders, or government acquisition proceedings.
  • That listed prices reflect exact market value — prices are approximate estimates only.
  • That boundaries depicted are legally verified — digital boundaries are inferred from BhuNaksha (Government of India portal) and may not reflect ground reality.

Buyers and investors must independently conduct due diligence, engage qualified legal counsel, and verify all land records through official government portals (e.g., DILRMP, State Revenue Departments) before entering any transaction.

8. Content Moderation & Platform Integrity

To maintain trust and platform quality, 2Bigha reserves the right to review, edit, restrict, or remove any content that is deemed misleading, unlawful, inappropriate, or in violation of these Terms, without prior notice.

9. Plan Upgrades & Downgrades

You may upgrade your subscription plan at any time during the billing cycle. The upgrade takes effect immediately. The full price of the new plan will be charged at the time of upgrade, and no credit, refund, or adjustment will be provided for any unused portion of the current subscription plan.

Downgrades: Downgrade requests take effect at the start of the next billing cycle. No refund is issued for the difference in the current cycle.

Switching billing frequency (e.g., monthly to quarterly) will take effect at the next renewal date.

10. User Responsibilities

As a user and/or subscriber of the 2Bigha platform, you agree to:

  • Provide accurate, current, and truthful information in your account and all listings.
  • Use the platform solely for lawful purposes and in compliance with all applicable Indian laws.
  • Respect the intellectual property and privacy rights of 2Bigha and third parties.
  • Not attempt to scrape, hack, reverse-engineer, probe, or misuse platform data or infrastructure.
  • Not create multiple accounts to exploit free trials or promotional offers.
  • Not list land that is under active legal dispute without appropriate disclosure.
  • Not use the platform for fraudulent misrepresentation, money laundering, or any criminal activity.

You are solely responsible for all activity conducted under your account.

11. No Brokerage or Legal Advisory

  • 2Bigha is a technology intermediary platform and does not act as a real estate broker, commission agent, or legal consultant under any applicable law, including the Real Estate (Regulation and Development) Act, 2016 (RERA).
  • Any transaction, negotiation, or agreement is exclusively between the buyer and the seller.
  • 2Bigha may connect users to empanelled legal or land experts; however, their advice is independent of 2Bigha and 2Bigha bears no liability for such advice.
  • Subscription fees do not constitute brokerage or advisory fees.

12. Intellectual Property

  • All content on the 2Bigha platform — including but not limited to the brand name, logo, website design, user interface, text, graphics, tools, software, features, data compilations, and methodologies — is the exclusive intellectual property of 2Bigha or its licensors.
  • Unauthorized use, reproduction, modification, distribution, or reverse engineering of any part of the platform is strictly prohibited.
  • Violation of our intellectual property rights may result in civil and/or criminal legal action.
  • Users retain ownership of content (photographs, documents) uploaded by them but grant 2Bigha a non-exclusive, royalty-free licence to use such content for platform purposes.

13. Data Privacy & Security

2Bigha is committed to protecting your personal data in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and the Digital Personal Data Protection Act, 2023.

  • Subscription-related data (name, contact, payment metadata) is stored securely and used solely for service delivery and communications.
  • We do not sell or share your personal data with third parties for marketing purposes without your explicit consent.

14. Limitation of Liability

To the maximum extent permitted by applicable law, 2Bigha shall not be liable for:

  • Any property-related dispute, fraud, misrepresentation, or financial loss arising from a transaction between users.
  • Losses arising from incorrect documentation, outdated government records, or changes in land law or policy.
  • Technical errors, service outages, data loss, or third-party service failures.
  • Inaccuracies in digital land boundaries derived from BhuNaksha or other government portals.
  • Any indirect, incidental, consequential, or punitive damages arising from your use of the platform.

In no event shall 2Bigha's aggregate liability to any user exceed the total subscription fees paid by that user in the 3 months immediately preceding the event giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless 2Bigha, its directors, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Terms or any applicable law.
  • Any listing, content, or information you submit to the platform.
  • Any transaction or dispute between you and another user.
  • Your infringement of any intellectual property or privacy right of a third party.

16. Account Suspension & Termination

2Bigha reserves the right to suspend or permanently terminate your account and subscription, with or without notice, if you:

  • Violate any provision of these Terms.
  • Engage in fraudulent, deceptive, or illegal activity on the platform.
  • Submit false land records, fabricated documents, or misleading listing information.
  • Abuse the free trial, refund, or promotional offer systems.
  • Fail to make payment within the stated grace period.

Upon termination for cause, no refund will be issued for any remaining subscription period. Active listings will be immediately removed.

17. Modifications to These Terms

2Bigha may update, amend, or modify these Terms at any time. When material changes are made, we will:

  • Post the revised Terms on our website with the updated effective date.
  • Communicate any changes to your registered email address. For material changes to subscription pricing or refund policy, notification will be sent via email before such changes take effect.
  • Apply such changes from the next subscription billing cycle.

Your continued use of the platform after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree, you must cancel your subscription and discontinue use of the platform.

18. Dispute Resolution

18.1 Informal Resolution

Before initiating any formal dispute, you agree to contact 2Bigha at contact@2bigha.ai and attempt to resolve the matter informally within 30 days of the dispute arising.

18.2 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Haryana, India, without regard to its conflict of law principles. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana.

18.3 Arbitration

All disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The proceedings shall be conducted in English and the seat and venue of arbitration shall be Gurugram, Haryana.

19. Force Majeure

2Bigha shall not be held liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay is caused by events beyond its reasonable control, including but not limited to acts of God, natural disasters, government orders, internet disruptions, cyberattacks, or pandemic-related restrictions.
